Delaware law permits a lawsuit for the benefit of the surviving spouse, parent, child and siblings of someone who died due to the negligence of another. Pursuant to 10 Del. C. section 3724, the lawsuit may claim:

  • deprivation of the expectation of pecuniary benefits to the beneficiaries that would have resulted from the continued life of the deceased;
  • loss of contributions for support;
  • loss of parental, marital and household services, including the reasonable cost of providing for the care of minor children;
  • reasonable funeral expenses not to exceed $7,000; and
  • mental anguish resulting from such death (the statute sets forth who can recover and under which circumstances, for example - parents only have a claim if there are no surviving spouse or children; siblings only have a claim if no surviving spouse, children, and parents).

Claim of Deceased's Estate

In addition to the wrongful death lawsuit, the Estate may bring a lawsuit at the same time for the pain and suffering of the deceased, and for any difference in the value of the deceased's assets had the deceased lived a full life.

Proving Economic Losses

In order to prove economic loss it is usually necessary to work with a Forensic Economist. Delaware law is very particular as to what can and cannot be claimed. Future losses must be reduced to present value by an economist.
